This section sets out Margaret River Fresh Produce Company’s terms & conditions for service and trade.
Please read these terms and conditions carefully as they form part of your agreement with Margaret River Fresh Produce Company. By accessing our website, registering as a customer or ordering products, you agree to comply with these terms and conditions. If you require clarification or have any questions please contact us at admin@mrfreshproduce.com.au.
Margaret River Fresh Produce Company may modify these terms and conditions from time to time in order comply with changing legislations and to provide the highest level of service and protection to our customers. Please check these terms for any changes before you order.
In order to become a customer with Margaret River Fresh Produce Company, you must be aged 18 or older and only proceed to check out using banking and personal details that you are authorized to use.
Trading terms on ordering
When ordering with Margaret River Fresh Produce Company you will need to provide all relevant details, including a contact person, delivery address and contact phone number. You may be refused an order at the sole discretion of Margaret River Fresh Produce Company at any time.
We may contact you
By placing an order you become a customer of Margaret River Fresh Produce Company. By doing so you accept that Margaret River Fresh Produce Company keeps a record of your personal details and may contact you in any of the contact forms provided (including email, SMS, telephone or such other means) in relation to:
- The delivery service, your account, any products, or in general about your order.
- Any marketing or promotion which we conduct, special products or specials being offered.
- Margaret River Fresh Produce Company newsletters or publications.
Upon receiving any of our communications you may unsubscribe from our newsletter following the link provided on such email or contacting us back via email to let us know if you’d like to make any changes.
We will not sell or give your information to any third party, or otherwise provide your details to another company without your consent.
You can choose to purchase one of our produce boxes as a one-time purchase or alternatively set up a recurring standing order. Our online payments platform is set up with Eway, ensuring that all transactions are encrypted and safe. You can read about Eway here.
All orders placed outside our cut off times are subject to not being delivered on time that week. If we are able to complete the order on time we will try our best to deliver that week despite being out of our set times. We work with set delivery dates depending on location yet delivery times cannot be guaranteed.
Changing your order
You can add to or cancel you order by contacting us back before the cut off time. After this time we may not be able to alter the order. Please contact us at orders@mrfreshproduce.com.au for any changes.
Receiving your products
You will receive the products to the delivery address you provide. Please ensure that your requested delivery location is free from obstructions and is otherwise in a clean and tidy state to prevent any delivery delays. Also be aware of possible weather conditions out of our control, so make sure there is an undercover area where the box can be left at.
At the time of delivery, no one is required to be present to take delivery. If you’d like your order to be placed in a specific spot, please explain this in the notes at checkout.
You own and are responsible for all products once they have been delivered to you. Please make sure that you check all products carefully against your tax invoice and take careful notice of fresh produce that needs to be refrigerated, ingredient lists, allergens, and any use by or best before dates on products.
Subscription policy
Margaret River Fresh Produce Farm Store provides a subscription service. By subscribing to our service, you have confirmed that you accept our Terms of Service.
Your membership will automatically renew on a recurring weekly basis. You will be charged automatically for the subscription order, including applicable shipping and handling fees until you cancel your membership. Since we have specific cut off times for our online orders, we may modify the day your next credit happens in order for your purchase to be within our set cut off times.
You may cancel and edit your membership at any time by logging on to our website under your client username and personal password.
Privacy policy
Margaret River Fresh Produce Company values the protection of your privacy, and treats your personal information with the highest levels of confidentiality.
We are committed to safeguarding your personal information and will always handle your personal information securely and carefully. Information that you supply directly to us is used only to provide the best service to our customers and personal information is always stored securely.
All data collected, whether directly or indirectly, is used only by Margaret River Fresh Produce Company and is never provided to any other party without your permission or to the extent required by law.
When placing an order on our website, we record sufficient personal details to confirm your identity, and to ensure we send goods to the correct address. At no time do we record your credit card information on our site.
Margaret River Fresh Produce Company will, on request, provide an individual with access to any information we hold about them. Margaret River Fresh Produce Company will comply with the principles as set out in the Privacy Act 1988 and the Privacy Amendment (Private Sector) Act 2000.
Public holidays
We continue to work on public holidays unless communicated differently on any of our online channels (Instagram, Facebook, website and newsletter). We request that customers place orders as early as possible.
Under the circumstances that we won’t be operating on a specific public holiday, we will notify all of our customers via social media.
Cost of delivery
Only orders over $50 can be delivered. A flat shipping rate of $10 applies to all orders except for orders over $100 where free shipping applies automatically.

Reporting an issue
At Margaret River Fresh Produce Company we pride ourselves on the quality of our produce and offer a 100% satisfaction guarantee to customers. If for any reason you have: received an incorrect item, your whole order has not been delivered, incorrect item/s were delivered or have received something that you are not 100% satisfied with, we will ensure that the product will be refunded or replaced.
However, you must notify Margaret River Fresh Produce Company via email at orders@mrfreshproduce.com.au within 24 hours of the delivery being made and return any products to the driver as directed.
No claim for damaged or unsatisfactory quality, or any other claims, will be recognized after 24 hours of receiving stock. Otherwise the customer will be deemed to have accepted the goods.
Margaret River Fresh Produce Company prides itself on customer service and will rectify any matter you are unsatisfied with where possible and within reason. Having said that, we are not responsible for any late delivery or failure to deliver due to circumstances beyond our reasonable control.
We cannot take responsibility for items left out for long periods, as the customer is responsible for ensuring the product reaches refrigeration as soon as possible after delivery. Please note that risk for loss or damaged product passes to the customer upon delivery of the product(s) by the driver. Unfortunately we cannot credit or replace stock damaged due to climatic, poor refrigeration or other condition after the goods have left Margaret River Fresh Produce Company’s control. Please note that risk for loss or damaged product passes to the customer upon delivery of the product(s) by the driver.
To ensure this risk is minimised Margaret River Fresh Produce Company will work with you and your delivery process to ensure a satisfactory process is in place.
Variations from pictured items
As all our products are a handmade or farm grown, some variation to pictures on the website make occur.
Product availability
Whilst we make every effort to ensure availability of all products in our range, unfortunately we cannot guarantee that goods advertised on our website will always be available. Although we will do our utmost to ensure that your order is fulfilled, if a purchase of an unavailable item is made, you will be not be charged for that item.
Intellectual property rights
Margaret River Fresh Produce Company owns and is licensed to use all of the Intellectual Property Rights on the website, including software, design, text, graphics, layout, content, and materials. You must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way, communicate to the public or use for commercial purposes, any material on our website without our prior written consent. This website contains registered trademarks and other trademarks which are protected by law.
You must not use any mark, logo or trademark appearing on the website, or our name or words or images associated with Margaret River Fresh Produce Company or the names of our products without our prior written consent. We will strenuously defend our Intellectual Property rights.
General Restrictions
You must not:
- Use the website or service for activities that breach any laws, infringe a third party’s rights or are contrary to any relevant standards or codes;

Changes to pricing
From time to time we may need to alter the price of our products due to the seasonality and price alterations from each supplier. This may result in the prices of the individual products being slightly different from the notified price. We will advise our customers via email and mail with notice prior to any price changes.
Special or seasonal products
Margaret River Fresh Produce Company may offer special or seasonal products. This can include hampers, retail packs, seasonal lines and special offers. From time to time, we may also offer special promotions or customer incentives which provide you with a discounted pricing. These promotions are subject to their own terms and conditions.
Legal obligation
We reserve the right to use or disclose any information without notice or consent as needed to satisfy any law, regulation or legal request; to conduct investigations of consumer complaints or possible breaches of law; to protect the integrity of our site and our property; to protect the safety of our visitors or others; to fulfil your requests; or to cooperate in any legal investigation as required by law.
